PAYMENT POLICY
This Payment Policy (“Policy”) governs payments, the use of Tune(s) where applicable, transaction completion, delivery of digital content, cancellations, refunds, and related billing matters in connection with the use of Tunessy.com (the “Site”).
This Policy forms an integral part of the Terms of Use. Any person using Tune(s) where applicable, making a Purchase, or otherwise completing a transaction through the Site is deemed to have read, understood, and accepted this Policy.
I. Definitions
For the purposes of this Policy, the following definitions apply:
- Company means A-Z SPECTRUM LTD.
- Site means Tunessy.com and the services and functionality made available through it.
- Sample means a digital audio file or a collection of files, including, for example, loops, stems, and one-shots, made available on the Site as a downloadable digital product, whether offered individually or as part of a sample pack. Access to and use of Samples are subject to the applicable purchase flow and terms published on the Site.
- Purchase means the acquisition of access to a Sample or sample pack through the Site in exchange for valid consideration accepted by the Company in accordance with the applicable payment terms and purchase mechanics made available on the Site.
- User Account means a registered user profile used to access account-based functions of the Site and access to purchased digital content.
- Tune(s) means the value, credit, or purchase unit that may be made available for use within a User Account for Purchases on the Site, as described on the Site.
II. Scope of the Policy
This Policy applies to payments and Purchases made through the Site, including the acquisition or use of Tune(s) where applicable, the purchase of Samples and Sample Pack, delivery of digital products, and related requests concerning cancellation, refund, duplicate charges, or billing issues. All products offered on the Site are digital products delivered electronically. No physical goods are sold or shipped.
III. Payment Processing and Available Methods
Payments made in connection with the Site are processed exclusively by independent third-party payment service providers selected or made available by the Company. The Company does not itself process payments, store full payment card details, or maintain payment credentials submitted in connection with a transaction.
All payment authorizations, validations, security checks, and related processing activities are performed by the relevant third-party payment service providers in accordance with their own terms, policies, and technical procedures. The Company is not responsible for the independent operation, availability, security, or data-handling practices of such third-party payment service providers.
The Company reserves the right to change, limit, suspend, or discontinue any available payment method or transaction option at any time.
IV. Tunes and Funding
The Site operates with account-based purchasing functionality that includes the use of Tune(s) within the relevant User Account. Tune(s) are made available solely for use within the Site and may be used only for eligible Purchases offered through the Site, in accordance with the applicable purchase mechanics published on the Site.
Tune(s) have no cash value outside the Site, are not a currency, and may not be redeemed, withdrawn, exchanged, or converted into money, monetary value, or any other form of value outside the Site, except where required by applicable law or where the Company expressly determines otherwise in connection with an approved refund or billing correction. Tune(s) may not be transferred, assigned, sold, gifted, or otherwise made available to another user, except where required by applicable law or expressly permitted by the Company.
Any payment made in connection with the acquisition of Tune(s) is made solely for the purpose of obtaining the ability to use such Tune(s) within the Site’s purchasing functionality. The Company does not undertake any general obligation to exchange Tune(s) for money, return Tune(s) in cash form, or provide any monetary payout, except where required by applicable law or where the Company expressly approves a fiat refund in accordance with this Policy.
The Company may apply minimum or maximum purchase amounts in relation to Tune(s).
V. Prices, Authorization, and Completion of Transactions
All prices for Samples and Sample Pack displayed on the Site are denominated in Tune(s). For the purposes of transactions on the Site, 1 Tune = 1 Euro. In order to make a Purchase, the holder of a User Account must first obtain the required amount of Tune(s) through the available payment process, after which Purchases are completed by applying the available Tune(s) balance within the relevant User Account to the selected Sample or sample pack.
A transaction relating to the acquisition of Tune(s) shall not be considered completed until it has been successfully authorized, received, and recorded by the Company’s systems, and the corresponding Tune(s) have been made available in the relevant User Account. A Purchase of a Sample or sample pack shall not be considered completed until the applicable amount of Tune(s) has been deducted from the relevant User Account and the corresponding access to the purchased content has been granted through that account.
The Company reserves the right to refuse, suspend, review, or cancel a transaction or Purchase where reasonably necessary, including in cases of suspected fraud, unauthorized activity, pricing error, technical malfunction, legal restriction, breach of the Terms of Use, or misuse of the Site.
VI. Delivery of Digital Content
All Samples and sample packs are delivered electronically through the relevant User Account.
Access to purchased content is normally granted through the relevant User Account after the applicable purchase process has been successfully completed and recorded by the Company’s systems. Delivery may occasionally be delayed due to payment verification, technical interruptions, maintenance, connectivity issues, third-party processing issues, or other circumstances beyond the reasonable control of the Company.
If a transaction is successfully completed but the corresponding purchased content is not made available correctly, the Company may, where appropriate and to the extent reasonably available, restore or grant access to the purchased content, re-enable delivery, correct the relevant Tune(s) or purchase value record, reverse a duplicate charge, issue a corresponding adjustment within the relevant User Account, or provide another appropriate remedy in accordance with this Policy and applicable law, including a fiat refund where the Company determines this to be appropriate or where required by applicable law.
VII. Cancellation
Because the Site supplies digital content delivered electronically, a Purchase generally cannot be cancelled once the applicable transaction has been completed and the relevant digital content has been made available through the relevant User Account, including where it has been accessed or downloaded.
By completing a Purchase and receiving access to digital content without delay, the holder of the relevant User Account acknowledges that performance begins once delivery is made through that account and that any cancellation rights that might otherwise apply may be lost to the extent permitted by applicable law.
Nothing in this section excludes or limits any mandatory rights available under applicable consumer protection law.
VIII. Refunds
Because the Site supplies digital content delivered electronically and Purchases are made using Tune(s) within the relevant User Account, all sales are generally final and refunds are not automatically available.
A user may contact the Company for review if:
- a payment was made but the corresponding Tune(s) were not credited to the relevant User Account;
- Tune(s) were deducted but access to the purchased content was not granted;
- more than one charge was made for the same transaction;
- an incorrect amount was charged due to a technical or billing error; or
- the digital content was not made available substantially as described, to the extent required by applicable law.
Where the Company confirms a genuine billing, technical, or delivery issue, it may provide an appropriate remedy, including re-crediting Tune(s) to the relevant User Account, restoring access to the purchased content, correcting the relevant transaction record, or taking another appropriate corrective step in accordance with this Policy and applicable law.
In limited circumstances, where the Company determines that a refund to the original payment method is appropriate or where such refund is required by applicable law, the Company may initiate a fiat refund through the relevant third-party payment service provider. Any such refund is generally processed back to the original payment method and may take approximately 5 to 10 business days to appear, although timing may vary depending on the relevant payment service provider, payment method, bank, or card issuer.
Except where a fiat refund is required by applicable law or otherwise expressly approved by the Company, refunds are generally not made to a bank card, payment card, or other external payment method and are instead reflected through Tune(s) or another corresponding adjustment within the relevant User Account.
Nothing in this section excludes or limits any mandatory rights available under applicable law.
IX. Duplicate Charges and Billing Issues
If a user believes that a payment was charged but the corresponding Tune(s) were not credited to the relevant User Account, that Tune(s) were deducted but access to purchased content was not granted, that more than one charge was made for the same transaction, or that another billing error occurred, the Company should be contacted promptly at info@tunessy.com with sufficient information for review, including the email associated with the User Account, the transaction date, the amount, and any available payment reference.
The Company may request additional information reasonably necessary to investigate the issue and, where appropriate, may correct the relevant Tune(s) balance, restore access, issue a corresponding account adjustment, initiate a fiat refund to the original payment method, or take another appropriate corrective step in accordance with this Policy and applicable law.
X. Chargebacks and Payment Disputes
If a payment issue arises, the relevant user is encouraged to contact the Company before initiating a chargeback or formal dispute with a card issuer or payment service provider.
If a chargeback, reversal, or payment dispute is initiated, the Company reserves the right, to the extent permitted by applicable law, to review the relevant User Account and transaction, suspend access to affected content or account features while the matter is under review, reverse or adjust any related Tune(s) or transaction value connected with the disputed payment, and restrict future transactions in cases of repeated or abusive disputes.
Nothing in this section excludes or limits any rights available under applicable law.
XI. Promotional Benefits and Non-Cash Value
The Company may offer discount codes, promotional Tune(s), or similar promotional benefits, subject to any conditions disclosed at the time of the relevant offer.
Except where required by applicable law, promotional benefits, Tune(s), discounts, bonuses, or similar non-cash value cannot be redeemed, exchanged, or converted into cash.
Partially used Tune(s) may not be redeemed for cash and may be used only within the Site, except where required by applicable law or expressly approved by the Company.
XII. Amendments to This Policy
The Company may modify this Policy. Any changes will take effect when published on the relevant page of the Site, unless otherwise stated.
Continued use of the Site after an updated version of this Policy is published constitutes acceptance of the revised Policy. Users are encouraged to review this Policy periodically.
