These Terms of Use (“Terms”) govern access to and use of the Site and the services made available through it. By accessing the Site, a user acknowledges having read, understood, and accepted these Terms in full. If these Terms are not accepted, the Site and its services must not be used.

I. Key Definitions

For the purposes of these Terms, the following definitions apply:

Company means A-Z SPECTRUM LTD.

Site means Tunessy.com, including its features, functionality, media previews, backend systems, software, design elements, and creative content owned or controlled by the Company.

Sample means a digital audio file or a collection of files, including, for example, loops, stems, and one-shots, made available on the Site as a downloadable digital product, whether offered individually or as part of a sample pack. Access to and use of Samples are subject to the applicable purchase flow and terms published on the Site.

Purchase means the acquisition of access to a Sample or sample pack through the Site in exchange for valid consideration accepted by the Company in accordance with the applicable payment terms and purchase mechanics made available on the Site.

User Account means a registered user profile required to make Purchases on the Site and access account-based features, protected by login credentials.

II. Scope of Services

The Site is a digital platform offering a curated library of royalty-free audio samples for hobbyists, musicians, content creators, producers, and media professionals seeking high-quality sound elements for use in their projects, subject to the applicable license terms.

The Samples made available on the Site are prepared, organized, and offered by the Company under clear licensing terms. Access to the Site and its services is available only to persons who comply with these Terms and applicable law.

Use of the Site and its services is permitted only to persons who have reached the age of legal majority in their country of citizenship, residence, or other applicable jurisdiction. Persons who do not meet these requirements must not use the Site or make Purchases through it.

The Company reserves the right to restrict access, suspend User Accounts, or decline service at its discretion, particularly in cases of suspected abuse, policy violations, fraudulent activity, or unlawful use of the Site.

III. User Registration and Responsibilities

To purchase Samples or access account-related features, creation of a User Account is required.

A user creating or maintaining a User Account must provide information that is not misleading, maintain the confidentiality of login credentials, and remain solely responsible for all activity carried out under the relevant User Account.

A User Account may not be transferred, assigned, or sublicensed to any other person. In the event of suspected unauthorized access, misuse, or a security incident affecting a User Account, the Company must be notified without undue delay, and the Company shall not be liable for any loss or damage resulting from unauthorized access if the user failed to notify the Company promptly.

The Company reserves the right to rename, suspend, deactivate, or reclaim usernames where reasonably necessary for brand protection, operational integrity, legal compliance, or prevention of misuse.

You may not transfer or sublicense your account to others. In the event of suspected unauthorized access or a data breach, you must notify us immediately. The Company reserves the right to rename, deactivate, or reclaim usernames if deemed necessary for brand protection or operational integrity.

IV. Licensing and Rights

All Samples offered through the Site are distributed under the Creative Commons Attribution 4.0 International License (CC BY 4.0). That license permits use, remixing, transformation, adaptation, and commercial exploitation of the Samples, provided that appropriate attribution is given to the original creator. A link to the license must also be included, and any changes made to the original material must be clearly indicated.

A Purchase grants the relevant user access to the applicable digital content through the Site and, subject to the applicable license terms, the right to use the relevant Sample. A Purchase does not transfer ownership of the Site, its software, branding, layout, or any other intellectual property except to the extent expressly permitted by the applicable license.

The CC BY 4.0 license applies strictly to copyright. Certain Samples may contain elements, such as recorded voices or recognizable sound cues, that could implicate other rights, including privacy, publicity, personality, or trademark rights. Responsibility for ensuring that use of the Samples does not violate any third-party rights in the context of a particular project remains with the relevant user. The Company does not guarantee clearance of such rights for every possible use case.

The Company may obtain, create, adapt, modify, or otherwise prepare audio materials made available on the Site using sources, materials, and rights arrangements the Company considers appropriate for its operations and intended use on the Site.

The Company takes reasonable steps to ensure that content made available on the Site is used under licensing arrangements the Company considers appropriate for its intended use on the Site.

V. Intellectual Property and Restrictions

Except for content expressly made available under CC BY 4.0, all intellectual property rights in and to the Site, including its branding, interface design, code, structure, layout, editorial content, and other proprietary elements, remain the exclusive property of the Company or its licensors.

No part of the Site or its non-licensed content may be reproduced, reverse engineered, copied, distributed, republished, sold, or commercially exploited except as expressly permitted by these Terms or by the applicable license.

Nothing in these Terms grants any right, title, or interest in the Site itself other than the limited right to use it in accordance with these Terms.

VI. Purchases, Delivery, and Related Policies

Samples on the Site are available exclusively to registered users through a User Account. The Site operates with account-based purchasing functionality, which may include the use of Tune(s) within the User Account, as described on the Site.

All matters relating to payments, the use of Tune(s) where applicable, transaction completion, cancellations, refunds, and related billing matters are governed by the applicable Payment Policy, which forms an integral part of these Terms.

Access to purchased content is normally granted through the relevant User Account after the applicable purchase process has been successfully completed and recorded by the Company’s systems. All products offered on the Site are digital products delivered electronically. No physical goods are sold or shipped.

VII. Limitations of Liability

The Site is provided on an “as is” and “as available” basis. The Company does not guarantee that the Site, its functionality, or its content will always be uninterrupted, error-free, secure, or free from viruses or other harmful components. The Company does not guarantee that any Samples or other content will meet a user’s expectations, requirements, or intended purpose.

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including any loss of business, revenue, profit, goodwill, data, or anticipated savings, arising out of or in connection with use of the Site or any content obtained from it, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability where such liability cannot be excluded or limited under applicable law.

Each user agrees to indemnify, defend, and hold harmless the Company from and against any claims, liabilities, damages, losses, and reasonable legal costs arising from use of the Site, misuse of any Samples, breach of these Terms, or violation of any applicable law or third-party rights.

VIII. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of England and Wales.

Any dispute arising out of or in connection with these Terms or use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by applicable law.

IX. Termination

The Company reserves the right to suspend, restrict, or terminate access to the Site or any User Account at any time, with or without notice, where it reasonably believes that these Terms have been violated or that the Site has been used in an unlawful, abusive, fraudulent, or otherwise improper manner.

A user may terminate acceptance of these Terms at any time by ceasing all use of the Site.

Termination or suspension shall not affect any rights, obligations, liabilities, completed transactions, license conditions, payment-related obligations, or provisions of these Terms that by their nature are intended to survive termination.

X. Amendments to These Terms

The Company may modify these Terms. Any changes will take effect when published on the relevant page of the Site, unless otherwise stated.

Continued use of the Site after updated Terms are published constitutes acceptance of the revised Terms. Users are encouraged to review these Terms periodically.
